These Terms of Service ("Terms") govern your access to and use of the websites, applications, cloud rendering services, design tools, VR/AR features, digital asset services, marketing workflow tools, APIs, integrations, and related services provided by House3D Company Limited ("House3D", "we", "our", or "us"). By accessing or using the Services, you agree to these Terms. If you use the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
You must provide accurate account information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify House3D immediately of any unauthorized access, suspected breach, or misuse of your account.
House3D provides cloud-based interior design, 3D visualization, VR/AR, cloud rendering, digital asset, collaboration, and marketing workflow features. We may modify, improve, suspend, or discontinue any part of the Services from time to time. We will make reasonable efforts to notify users of material changes where appropriate.
You retain ownership of the content, designs, files, images, videos, 3D models, textures, project data, and other materials that you upload or create using the Services ("User Content"). You grant House3D a limited, worldwide, non-exclusive license to host, store, copy, process, transmit, display, render, transform, and otherwise use User Content solely as necessary to provide, maintain, secure, support, and improve the Services.
You represent that you have all rights necessary to upload and use User Content and that your User Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party.
You may not use the Services to violate laws, infringe third-party rights, upload unlawful or harmful content, interfere with service operation, attempt unauthorized access, reverse engineer protected software, distribute malware, abuse APIs, scrape data without permission, misrepresent identity, or use the Services in a way that may harm House3D, other users, or third parties.
Rendering times, output quality, storage availability, and processing capacity may vary depending on scene complexity, resource availability, account plan, and technical conditions. You are responsible for reviewing outputs before publishing or using them commercially. House3D may apply reasonable limits to storage, rendering jobs, API usage, bandwidth, and processing to protect service performance.
Some Services may require a paid subscription, prepaid credits, usage-based fees, enterprise agreement, or other payment arrangement. Fees, billing cycles, renewal terms, cancellation terms, taxes, and refund policies will be described in the applicable order, invoice, plan description, or agreement. Unless otherwise stated, fees are non-refundable to the maximum extent permitted by law.
The Services may integrate with third-party platforms, applications, APIs, cloud providers, payment processors, identity providers, social platforms, and advertising platforms. Your use of third-party services may be subject to third-party terms and privacy policies. House3D is not responsible for third-party services that we do not control.
Users may optionally connect their Facebook or Meta account to House3D using Facebook Login or other authorization mechanisms provided by Meta Platforms. By connecting a Meta account, you authorize House3D to access and process information permitted by your authorization, these Terms, our Privacy Policy, and Meta's applicable policies.
House3D may provide features that allow authorized users to connect Meta Business assets and advertising accounts, read advertising reports, synchronize campaigns, manage ad accounts, upload advertising creatives generated or selected through House3D, create or update campaigns, ad sets, ads, and creatives, and display advertising insights within the House3D platform.
You may use these features only for ad accounts, businesses, Pages, Instagram accounts, and advertising assets that you own or have been granted permission to access by the asset owner. You are responsible for ensuring that your use of Meta advertising features complies with all applicable laws, Meta Platform Terms, Meta Advertising Standards, Meta Marketing API terms, and any other applicable Meta policies.
House3D does not guarantee approval, delivery, performance, reach, conversion, or results of any advertising campaign. Meta may reject, pause, limit, or remove advertising assets according to its own policies and systems.
If House3D provides API access, you must use it only as permitted by House3D documentation and applicable agreements. We may enforce rate limits, usage limits, authentication requirements, logging, security checks, and abuse-prevention measures. Excessive, abusive, insecure, or unauthorized API usage may result in suspension or termination of access.
House3D and its licensors retain all rights, title, and interest in the Services, software, technology, designs, trademarks, logos, documentation, interfaces, and other proprietary materials. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on the Services.
Our Privacy Policy explains how we collect and process personal information, including information received through Facebook Login and Meta integrations. By using the Services, you acknowledge that House3D will process information as described in the Privacy Policy.
We may suspend or terminate your access to the Services if you violate these Terms, create security or legal risk, fail to pay fees, misuse the Services, infringe third-party rights, or use the Services in a way that may harm House3D, other users, or third parties. You may stop using the Services at any time and may request account deletion according to our Privacy Policy.
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, House3D disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, and availability.
To the maximum extent permitted by law, House3D will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunity, or business interruption. To the maximum extent permitted by law, House3D's aggregate liability arising out of or relating to the Services will not exceed the amount paid by you to House3D for the Services during the twelve months before the event giving rise to the claim.
You agree to indemnify and hold harmless House3D, its affiliates, officers, directors, employees, contractors, and agents from claims, damages, liabilities, losses, and expenses arising from your User Content, your use of the Services, your violation of these Terms, your violation of law, or your infringement of third-party rights.
These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles, unless applicable law requires otherwise. The parties will attempt to resolve disputes in good faith before initiating formal proceedings.
We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date and may notify users through the Services, by email, or by other appropriate means. Continued use of the Services after the changes become effective means you accept the updated Terms.
